Bangsamoro Government clarifies: MPs filing COCs not deemed resigned

This clarification comes in response to a statement made by Senate President Francis "Chiz" Escudero, who suggested that MPs filing COCs would be deemed resigned.
Bangsamoro Government Spokesperson Mohd Asnin Pendatun, in a press conference, explained that while candidacy generally implies resignation, the nature of the MPs' positions must be considered.
"The perspective on the position of members of parliament is political by nature, although appointed by the president, so they are not considered resigned from their posts," Pendatun stated.
He cited legal opinions sought from the Commission on Elections (COMELEC) in 2022, which supported this interpretation.
Pendatun further highlighted that this precedent has been established in previous elections, citing the case of officials appointed by former President Benigno Aquino III who were not considered resigned after filing their COCs for the 2013 elections in the Autonomous Region in Muslim Mindanao (ARMM).
This means that BTA members can continue serving in their current capacity until the official results of the 2025 elections are announced. The Bangsamoro Government remains committed to upholding the rule of law and ensuring a peaceful and democratic transition towards a more prosperous and inclusive Bangsamoro.
The BTA members have assured the public that they will continue to deliver public services uninterrupted and remain dedicated to fulfilling their responsibilities until their terms officially end.
