Bangsamoro Government seeks to re-include Sulu in BARMM thru SC intervention

COTABATO CITY – The Bangsamoro Government, through its Bangsamoro Attorney General's Office (BAGO), has filed a motion for leave to intervene and a motion for partial reconsideration with the Supreme Court (SC) seeking to re-include Sulu province in the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM).
The twin motions were filed on Tuesday, October 1, following the BARMM's receipt of the SC decision on September 16, which excluded Sulu from the region based on the province's 54% negative vote in the 2019 plebiscite.

Atty. Mohammad Al-Amin Julkipli, Officer-in-Charge of the BAGO, explained that the motion for leave to intervene aims to formally include the BARMM as a party in the case, which was filed in 2018 before the region was officially constituted.

“For us in the BARMM, there is a special circumstance because when this case was filed in 2018, the BARMM was not yet constituted. When it was already pending in the Court, the BARMM, even though it has already been constituted, was not formally impleaded; meaning, throughout the life of the case, the autonomous region itself was never a party,” Julkipli said.

The motion for partial reconsideration specifically targets the SC's decision to exclude Sulu, arguing that the province is fundamental to the Bangsamoro identity and plays a vital role in the region's pursuit of autonomy and development.

The BARMM's legal team emphasized that the SC decision, while partially granting the petition, is not yet final and executory. This, they argue, allows for the regional government's legal maneuvers, highlighting the language of the law which states that the decision is "immediately executory" rather than "final and executory."

Julkipli expressed cautious optimism, stating, “It is also because we exerted all our diligence to really make this as foolproof as we can so we can really be convincing and we can really influence the result that we want.”
