Darul-Ifta’: Forcing woman to marry her rapist is forbidden

COTABATO CITY – The Bangsamoro Darul-Ifta' (BDI) has issued a fatwa (religious edict) declaring that it is impermissible to force a woman to marry her rapist. 

The fatwa, posted on BDI's official Facebook page on February 27, emphasizes that rape is a grave crime in Islam, warranting severe punishment, and that victims are entitled to protection and justice.
 
The fatwa clarifies that rape is a serious crime in Islam, with punishments varying depending on the circumstances. If the rape involves the use of weapons, abduction, or threats, it is considered Hirabah (waging war against society) and carries a heavier penalty. In all cases, the victim is innocent and deserves protection and justice.
 
The fatwa further asserts that marriage is only valid with the explicit and voluntary consent of the woman, after justice has been served. No guardian or entity has the right to force a woman into marriage against her will. This ruling is based on the Islamic teaching which stipulates that a woman's consent is a prerequisite for a valid marriage contract.

Ninotchka Rosca, a Filipina author, journalist, and a women's rights advocate, in her comment on the BDI's post said, "Forcing a woman to marry her rapist is punishing her to a lifetime of abuse.  This is good."
 
The fatwa underscores Islam's commitment to justice, compassion, and the dignity of women. It aims to protect vulnerable individuals and ensure that they are not further victimized by being forced into marriage with their abusers.
